This page is a working draft prepared to give an attorney a concrete starting point, not a finished legal document. It accurately describes what GearCaddie does today, but it has not been reviewed by a lawyer and should not be relied on as final until it has.

1. Acceptance of these terms

By using GearCaddie (the website, and the equipment search, camera-scan, and player-profile features on it), you agree to these Terms of Service. If you don't agree, please don't use the site. GearCaddie is currently in beta — features, pricing, and functionality are actively changing.

2. What GearCaddie is

GearCaddie is a golf equipment search and information site. It lets you search a catalogue of golf clubs, view researched information about specific models (specs, technologies, and GearCaddie's own assessment of who a club suits), scan a club with your camera to identify it, and optionally build a free player profile to save clubs and set price-alert preferences.

GearCaddie is not currently a retailer. We do not sell golf equipment directly, and as of this version of the site, no purchase, checkout, or payment happens on GearCaddie itself.

3. Information accuracy

GearCaddie researches club information from manufacturer sources and reputable golf publications, and clearly distinguishes between verified manufacturer facts and GearCaddie's own editorial fit assessments. Even so, equipment specs, availability, and prices can change, and GearCaddie can make mistakes. Nothing on GearCaddie is professional club-fitting advice — for a fitting decision that matters to your game or your money, verify with the manufacturer or a certified fitter before you buy.

4. Your player profile

If you build a player profile (handicap, swing tendencies, saved clubs, price-alert preferences), that information is currently stored only in your own browser — it is not sent to or stored on a GearCaddie server. Clearing your browser data or using a different browser/device will remove it. See our Privacy Policy for details.

5. Third-party links and retailers

Where GearCaddie shows retailer pricing or links to a retailer's site, that retailer — not GearCaddie — is responsible for the accuracy of its own prices, inventory, and the transaction itself. See our Affiliate Disclosure for how GearCaddie may earn a commission from those links.

6. Trademarks

Brand and product names shown on GearCaddie (Titleist, TaylorMade, PING, and others) are trademarks of their respective owners. We use them only to identify and describe real products, not to suggest that any brand endorses or is affiliated with GearCaddie.

7. Acceptable use

Please don't use GearCaddie to scrape or resell our catalogue data at scale, attempt to disrupt the service, or misuse the camera-scan or search features (for example, automated abuse). We may limit or suspend access for behavior that harms the service or other users.

8. No warranty; limitation of liability

GearCaddie is provided "as is," during an active beta period, without warranties of any kind. To the fullest extent permitted by law, GearCaddie is not liable for decisions made based on information found here, including equipment purchases made through a third-party retailer link.

9. Governing law

These terms are governed by the laws of the Province of Quebec and the laws of Canada applicable in Quebec, without regard to conflict-of-law rules. If a dispute can't be resolved directly, the courts of Quebec have jurisdiction.

10. Changes to these terms

We may update these terms as GearCaddie's features change, especially as affiliate retailer links, pricing, and paid membership features go live. Meaningful changes will be reflected in the "last updated" date above.
